ANGLING SPIRIT
TERMS AND CONDITIONS OF ENTRY, BOOKING AND PARTICIPATION

  1. INTRODUCTION

1.1 Application of these Terms

These Terms and Conditions (“Terms”) govern bookings, entries, participation, sponsorship arrangements and other services supplied by Angling Spirit Ltd (“Angling Spirit”, “we”, “us” or “our”).

These Terms apply together with any event-specific rules, regulations, entry requirements and policies expressly applicable to the relevant Event.

You must read these Terms and the applicable Event Rules carefully before completing your booking or registration.

Nothing in these Terms affects any statutory rights that cannot lawfully be excluded or restricted.

1.2 Interpretation

In these Terms:

“Angling Spirit”, “we”, “us” and “our” mean Angling Spirit Ltd.

“Customer”, “Participant”, “Competitor”, “you” and “your”, as applicable, mean the individual or legal entity making the booking, entering the Event, purchasing services or entering into an agreement with Angling Spirit.

“Event” means any competition, activity or associated event organised or operated by Angling Spirit.

“Event Rules” means the rules, regulations, safety requirements, registration requirements and official instructions applicable to the relevant Event.

“Captain” means the person designated as the principal representative and administrative contact for a competition entry.

“Entry” or “Basic Entry fee” means the minimum number and composition of Participants required under the applicable Event Rules to form a valid competing entry in the relevant Event, together with the applicable basic entry fee.

“Extras” means any additional Participants, helpers, team entries, Sponsor Link packages or other optional additions which do not form part of the basic Entry.

1.3 Angling Spirit Events

Angling Spirit owns, operates and/or manages a number of angling competitions, activities and associated initiatives, including the World Carp Classic, World Catfish Classic, World Predator Classic, World Street Fishing, World Sea Classic, Sea Angling Classic and Spirit OF Angling together with associated or derivative events and initiatives.

Unless expressly stated otherwise in writing, these Terms apply to all Events operated by Angling Spirit.

Where Event-specific terms or Event Rules impose additional requirements, those requirements shall apply in addition to these Terms. In the event of a direct inconsistency, the Event-specific provision shall apply to the extent of that inconsistency.

  1. THE CONTRACT

2.1 Formation of Contract

Submission of a registration, booking form, sponsorship agreement or order constitutes an offer to purchase the relevant Entry, sponsorship package, product or service.

Unless expressly confirmed otherwise by Angling Spirit in writing, a binding contract will arise only when:

  1. Angling Spirit has accepted the booking or agreement; and
  2. the minimum payment required to secure the booking has been received by Angling Spirit in cleared funds.

The status shown against an Entry on an official Event list shall have the meaning set out in Section 7 below.

2.2 Acceptance of Event Rules

Participation in an Event is conditional upon compliance with:

  • these Terms;
  • the Event Rules;
  • applicable safety requirements;
  • applicable laws and regulations;
  • requirements imposed by the venue, landowner or competent authority; and
  • reasonable instructions issued by Angling Spirit, Event Officials or Marshals.

2.3 Participant Acknowledgement and Acceptance

By submitting a booking or registration, making payment, entering into a sponsorship arrangement or otherwise confirming participation in an Event, the Participant confirms that they have had the opportunity to read and understand these Terms and the applicable Event Rules and agrees to be bound by and comply with them.

Where required, Participants must reconfirm their acceptance of these Terms and the applicable Event Rules by completing or signing any registration form, declaration, disclaimer or other participation document specified by Angling Spirit.

Where a Participant is under 18, any consent required from a parent or legal guardian must be provided in the form specified by Angling Spirit.

Participation in an Event remains subject to completion of all mandatory registration, documentation and eligibility requirements.

2.4 Party Leader

Where a booking is made for more than one person, the person making the booking shall be treated as the party leader unless Angling Spirit agrees otherwise.

The party leader confirms that they have authority to make the booking on behalf of every person included within it and, where applicable, have obtained the authority of the parent or legal guardian of any person under the age of 18.

The party leader is responsible for ensuring that all persons included in the booking are made aware of these Terms and the applicable Event Rules.

Where the booking includes a person under the age of 18, the Party Leader must ensure that any required consent from that person’s parent or legal guardian is obtained and provided to Angling Spirit in the form specified.

2.5 Applicable Version

The version of these Terms accepted at the time the contract is formed will apply to that contract, subject to any changes which may lawfully be made under these Terms or which are reasonably necessary for safety, legal, regulatory or operational reasons.

Participants are advised to retain a copy of the Terms applicable to their booking.

2.6 Language and Governing Law

These Terms are provided in English.

The contract shall be governed by the laws of England and Wales.

Nothing in this clause deprives a consumer of any mandatory protection or jurisdictional rights available under applicable consumer law.

  1. PARTICIPATION CAPTAINSHIP AND AGE

3.1 Minimum Age

The permitted age of participation may vary between Events. The applicable minimum age and any additional requirements for minors will be specified in the Event Rules or official registration information.

For the purpose of determining a Participant’s age, the relevant date shall be the first day of official registration for the Event.

The minimum age for participation, and whether a Participant under 18 is required to be accompanied by a parent or legal guardian, will depend on the requirements of the relevant Event and will be specified in the applicable Event Rules.

Where the Event Rules permit a Participant aged 16 or over to participate without a parent or legal guardian being present, this does not remove any requirement for parental or guardian consent that may apply to a person under 18.

3.2 Captain

The Captain is the principal administrative contact for an Entry.

The Captain is responsible for:

  • receiving administrative and Event communications;
  • communicating relevant information to all members of the Entry;
  • ensuring required forms and documents are submitted within the applicable deadlines;
  • ensuring all members of the Entry understand the Event Rules; and
  • where boats are permitted, complying with any responsibilities specifically allocated to the Captain under the Event Rules.

A person under 18 may not act as Captain.

Where an Event involves the use of boats, no person under 18 may operate or occupy a boat alone.

Where an Event involves the use of boats, the Captain will be responsible for the boat and its use during the Event, in accordance with the applicable Event Rules. Any change of Captain must be approved in advance by Angling Spirit.

  1. PRICES

Prices payable for Entries, Extras and other services will be those displayed on the official registration system, quotation, contract or invoice applicable to the transaction.

Unless expressly stated otherwise, prices payable by sponsors are exclusive of VAT and any other applicable taxes.

Where the amount of the non-refundable Entry deposit is not expressly specified at the time of booking, it shall be equal to one-third of the basic Entry fee, subject always to applicable consumer law.

Except where Angling Spirit has expressly agreed to an instalment arrangement, payment is due in accordance with the payment terms displayed during registration or stated on the relevant invoice.

Angling Spirit may amend prices for future bookings at any time. A subsequent price change will not alter the agreed price of a contract already formed unless expressly permitted under these Terms or agreed between the parties.

  1. PAYMENTS

5.1 Cleared Funds

All amounts due to Angling Spirit must be received in full in pounds sterling and in cleared funds unless another currency has expressly been agreed.

Any amount displayed in euros or another currency for information purposes only shall not alter the sterling amount contractually due.

All payments must be received by Angling Spirit in full and in cleared funds. The Participant is responsible for any bank, foreign-exchange, currency-conversion or intermediary charges imposed in connection with making the payment, to the extent permitted by law. Any charges imposed directly on Angling Spirit in connection with the Participant’s chosen payment method will only be passed on to the Participant where permitted by law.

5.2 Payment Processing Charges

Any payment-processing or transaction charge passed to a Participant will be disclosed in accordance with applicable law before it becomes payable.

Angling Spirit will not impose a payment surcharge where doing so is prohibited by law.

Where a charge is lawfully recoverable and is passed to the Participant, Angling Spirit may provide reasonable evidence of that charge upon request.

5.3 Outstanding Balances

Participants may receive reminders concerning outstanding balances.

Unless another deadline has been specified for the relevant Event, all amounts must be paid no later than completion of on-site registration.

Failure to pay an amount when due may result in cancellation of the booking in accordance with these Terms.

5.4 Cash Payments

Where cash payments are accepted, Angling Spirit may impose a reasonable handling charge where legally permissible, provided that the charge and its amount have been disclosed to the Participant before payment is made.

5.5 Multi-Pay Arrangements

Angling Spirit offers Participants the option to pay the Entry fee by instalments (“Multi-Pay”).

Unless stated otherwise, the first instalment will constitute the Entry deposit.

Participants are responsible for ensuring each instalment is paid by its due date.

If an instalment is missed, Angling Spirit may withdraw the Multi-Pay arrangement and require immediate payment of the outstanding balance.

Where the outstanding balance remains unpaid for seven days following a final written payment reminder, Angling Spirit may cancel the Entry. Any refund or cancellation charge will then be determined in accordance with the applicable cancellation provisions of these Terms.

  1. STATUTORY CANCELLATION RIGHTS

Where applicable law gives a consumer a statutory right to cancel a distance contract, Angling Spirit will honour that right in accordance with the applicable legislation.

Under Regulation 28 of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory right to cancel within 14 days does not apply to contracts for services related to leisure activities where the contract provides for a specific date or period of performance.

To exercise a statutory cancellation right, the Captain must provide Angling Spirit with a clear written statement of their decision to cancel before expiry of the applicable cancellation period.

Where the Captain has expressly requested that services commence during the statutory cancellation period, the Captain may be required to pay for services already supplied to the extent permitted by law.

Nothing in these Terms limits or excludes a statutory cancellation or refund right which cannot lawfully be excluded.

  1. ENTRY STATUS AND CONFIRMATION

The following status descriptions may be used on Angling Spirit’s official Event lists:

Pending – a place has been provisionally allocated but the required payment has not yet been received. A Pending place is not secured and may be reallocated.

In Progress – evidence of payment has been supplied and Angling Spirit is awaiting receipt of cleared funds. Unless otherwise agreed, Angling Spirit may release the place if payment has not cleared within 48 hours.

Approved – the minimum Entry deposit has been received and the place is secured subject to payment of the remaining balance in accordance with the applicable payment schedule.

Confirmed – the full basic Entry fee has been received in cleared funds.

Where an Approved Entry falls more than 28 days behind the applicable payment schedule, Angling Spirit may cancel the Entry after providing reasonable notice. The cancellation provisions in these Terms will then apply.

7.1 Extras

Extras are additional to the basic Entry fee.

Extras will ordinarily be confirmed only once the applicable payment has been received in full.

An Extra appearing against an Entry on the official Event list 21 days before the commencement of on-site registration shall be treated as confirmed and payable unless Angling Spirit agrees otherwise in writing.

  1. TRANSFER OR POSTPONEMENT OF AN ENTRY BY THE PARTICIPANT

A Participant has no automatic right to transfer an Entry to another Event or year.

Any transfer or postponement requested by a Participant must be expressly approved by Angling Spirit in writing.

Once a transfer has been agreed, the Entry will become subject to the prices, Terms and Event Rules applicable to the Event or year into which it has been transferred.

Where a Participant requests postponement:

  • the basic Entry fee must ordinarily have been paid in full and the Entry have Confirmed status;
  • requests received at least 120 days before the Event may be accepted subject to any increase in the Entry fee or Extras applicable to the new Event;
  • postponement into a particular year is subject to the availability and format of the relevant Event.

Any discretionary postponement or transfer does not create a precedent or obligation upon Angling Spirit to approve another request.

  1. CANCELLATION BY THE PARTICIPANT

Cancellation must be notified to Angling Spirit in writing by the person who made the booking or another person authorised by them.

Cancellation takes effect on the date Angling Spirit receives the written notice sent to our customer service team at admin”@” anglingspirit.com.

Subject to any statutory cancellation rights, the following cancellation charges apply:

180–121 days 50% of monies received, including Extras, but not less than the Entry deposit
120–91 days 75% of monies received, including Extras, but not less than the Entry deposit
90 days or fewer before the Event 100% of monies received, including Extras

These charges represent Angling Spirit’s contractual cancellation charges and are subject to any rights or remedies which the Customer has under applicable law.

  1. REFUNDS

10.1 Contractual Refunds

Where a refund is due under these Terms:

  1. the calculation will be based on the amount actually received by Angling Spirit in cleared funds;
  2. any applicable cancellation charge will be deducted in accordance with the Cancellation Fee Table;
  3. the Customer must provide any information reasonably required by Angling Spirit to process the refund; and
  4. Angling Spirit will process the refund without undue delay and, where applicable, within any period required by law.

Unless otherwise required by law, Angling Spirit aims to process contractual refunds within 28 days after all information necessary to process the refund has been received and verified.

A Participant who does not attend an Event without having given prior notice of cancellation will ordinarily forfeit the amounts paid, subject to any rights the Participant may have under applicable law.

Where an Event has been postponed or rescheduled by Angling Spirit in accordance with Section 12, the Participant will not automatically be entitled to a contractual refund solely as a result of the postponement, as their Entry will be transferred to the rescheduled Event, subject always to any statutory rights which cannot lawfully be excluded.

Where a refund has been made in respect of a postponed or rescheduled Event and the Participant subsequently wishes to re-enter that Event, any new Entry will be subject to availability and the Entry, registration and payment conditions applicable at that time.

10.2 Exceptional Refunds

Angling Spirit may, at its discretion, agree to issue a refund in circumstances where no refund is otherwise due under these Terms. Any such refund is discretionary and does not create a precedent or obligation to provide a refund in any other case.

Any conditions attached to an exceptional refund must be confirmed by Angling Spirit in writing.

Where Angling Spirit agrees to provide an exceptional refund because the Participant’s Entry has been successfully resold or reallocated, Angling Spirit may deduct reasonable administration costs and any third-party financial or transaction costs actually incurred in connection with the original payment and refund, subject to a minimum administration fee of £50 and to the extent permitted by law.

10.3 Refund Payment Procedure

Where a refund is due, the Participant will be required to complete the relevant refund payment form and provide the information reasonably required by Angling Spirit to process and verify the payment.

Angling Spirit will process the refund using the payment details provided by the Participant on that form. The Participant is responsible for ensuring that all information submitted is complete, accurate and valid.

If the information provided cannot be verified, is rejected by the payment system or is otherwise insufficient to process the refund, Angling Spirit may require the Participant to confirm or correct the information or submit a new form with alternative payment details.

Where incorrect or incomplete information supplied by the Participant results in a refund being rejected, returned or requiring reissue, Angling Spirit may deduct any reasonable additional costs actually incurred as a result, to the extent permitted by law.

By submitting the refund payment form, the Participant acknowledges that the refund will be processed in accordance with these Terms and any applicable legal requirements.

  1. OVERDUE AMOUNTS

Where legally permissible, overdue commercial invoices may accrue interest and recovery charges in accordance with the contract and applicable law.

For consumer Entries, Angling Spirit may charge interest or administrative costs only to the extent that such charges have been properly disclosed, are fair and are permitted by applicable law.

Angling Spirit may refuse a new Entry from a Customer who has an undisputed overdue balance from a previous Event until that balance has been paid.

  1. CANCELLATION, POSTPONEMENT OR MATERIAL CHANGE BY ANGLING SPIRIT

Events may be affected by circumstances outside Angling Spirit’s reasonable control, including, but not limited to, severe weather, flood, drought, fire, epidemic or pandemic, war or threat of war, civil disturbance, industrial disputes, governmental or regulatory action, the closure or withdrawal of a venue, or the unexpected closure or unavailability of facilities required for the Event.

Where such circumstances prevent or materially affect the staging of an Event as scheduled, Angling Spirit reserves the right to postpone and reschedule the Event, at no additional Event entry cost to Participants, to a date within the following 24 months and at the same venue or a suitable alternative venue.

Angling Spirit will inform affected Participants as soon as reasonably practicable and will provide the options required by applicable law together with any additional options Angling Spirit elects to offer.

Where an Event is postponed by Angling Spirit and rescheduled to new dates, all Entries, payments and Extras will automatically be transferred to the rescheduled Event. No contractual refund will be due solely as a result of the postponement, subject always to any statutory rights which cannot lawfully be excluded.

Once Angling Spirit has formally confirmed and communicated the new Event dates, the Participant’s right to cancel will be determined by reference to those new dates. The cancellation periods and applicable cancellation charges set out in the Cancellation Fee Table will therefore restart and be calculated from the date on which the rescheduled Event is due to commence.

Any cancellation requested by a Participant following confirmation of the new Event dates will be treated as a Participant cancellation and any refund due will be calculated in accordance with the Cancellation Fee Table applicable at the date Angling Spirit receives the written cancellation request.

Nothing in this Section excludes or restricts any refund, cancellation or other statutory right which a consumer is legally entitled to exercise.

Angling Spirit is not responsible for independently booked travel, accommodation, ferry crossings, vehicle hire or other third-party arrangements except to the extent liability cannot lawfully be excluded. Participants are strongly advised to obtain appropriate travel and cancellation insurance.

  1. LIABILITY

Nothing in these Terms excludes or limits liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • breach of statutory rights which cannot lawfully be excluded or restricted; or
  • any other liability which cannot lawfully be excluded or limited.

Subject to the above, Angling Spirit will not be responsible for losses which were not reasonably foreseeable when the contract was formed or which arise from circumstances outside its reasonable control, except where applicable law provides otherwise.

  1. PARTICIPANT RESPONSIBILITIES

Participants are responsible for ensuring that they satisfy all requirements necessary to attend and participate in the Event, including obtaining any required:

  • passports and visas;
  • fishing licences and permits;
  • boat documentation;
  • insurance;
  • vaccinations; and
  • other documents specified by Angling Spirit or the relevant authorities.

Participants must provide accurate emergency and next-of-kin information where required.

Medical Information
Participants must inform Angling Spirit before the Event of any medical condition, health requirement or ongoing treatment that may materially affect their safe participation in the Event or may require specific assistance in the event of an emergency. Participants remain responsible for carrying and managing any medication or treatment they require during the Event.

14.1 Behaviour

Participants must behave responsibly and must not cause danger, injury, harassment, serious disturbance or damage to other persons, property, Event staff, officials, venues or the environment.

Where Angling Spirit reasonably considers a Participant’s conduct to present a material safety, welfare or operational risk, Angling Spirit may take appropriate action, including removal from the Event or disqualification in accordance with the Event Rules.

14.2 Insurance

Participants are responsible for obtaining any insurance expressly required by the relevant Event Rules.

Where personal public liability insurance is mandatory, the policy must provide the level and nature of cover specified in the Event registration requirements.

Where boats are used, appropriate boat insurance is strongly recommended. Boat insurance will only be compulsory where required by applicable law, local authorities or the specific Event Rules.

The specific insurance requirements applicable to each Event shall be stated in its Event Rules or registration information.

  1. EQUIPMENT AND PROPERTY PROVIDED BY ANGLING SPIRIT

Any equipment loaned or supplied temporarily by Angling Spirit remains the property of Angling Spirit unless expressly stated otherwise.

From the time an item is issued until it has been formally returned and its return acknowledged, the Participant or Entry to whom it was issued is responsible for taking reasonable care of it.

All loaned Event equipment, including GPS tracking devices and other electronic equipment, must be returned at the time, place and in the manner specified by the Organisers.

Participants will be required to sign equipment in and out. Pictures may also be taken.

Where equipment is lost, deliberately damaged or damaged through negligence, Angling Spirit may recover the reasonable cost of repair or replacement from the responsible Participant or Entry.

Any security deposit taken against Event equipment will be dealt with in accordance with the specific deposit conditions communicated when the equipment is issued.

Failure to return Event equipment may result in withholding of prizes or other sums otherwise payable where legally permissible and in accordance with the Event Rules.

  1. PARTICIPANTS’ PROPERTY

Participants remain responsible for their own vehicles, boats, trailers, tackle, equipment and personal possessions at all times.

Angling Spirit and the host venue will not be responsible for loss, theft or damage except where such loss or damage results from negligence or another liability which cannot lawfully be excluded.

Participants should maintain appropriate insurance for valuable equipment.

  1. PRIZES

Entitlement to any cash, product, trophy or other prize is subject to full compliance with these Terms & Conditions and the applicable Event Rules.

The final Prize Table may be adjusted on a pro-rata basis according to the number of confirmed Entries in the Event, where this has been disclosed as part of the Event’s published prize structure.

Once a prize has been officially awarded and transferred to the winner, responsibility for its possession, safekeeping and, where appropriate, insurance passes to the winner.

17.1 Sponsor Prizes

Prizes provided by Event sponsors are supplied by the relevant sponsor and remain subject to that sponsor fulfilling its commitment to provide them.

Unless expressly stated otherwise, the advertised value of a sponsor-provided prize is its Recommended Retail Price (RRP) at the time the Prize Table is published. Angling Spirit is not responsible for any subsequent change in the market or retail value of such prizes.

Where a sponsor withdraws, fails to provide an agreed prize, or changes or substitutes a prize, Angling Spirit will use reasonable endeavours to provide a suitable replacement or alternative of comparable value, where reasonably practicable.

17.2 Claim of Cash Prizes

Cash prize winners will be provided with details of the Cash Prize Redemption procedure at the prize-giving ceremony or, where this is not reasonably practicable, within 14 days thereafter.

To claim a cash prize, the winner must complete and submit the official Cash Prize Redemption Form within 180 days of prize giving, providing all information reasonably required to verify and process the payment.

If no valid claim is made within the 180-day period, the cash prize will automatically be converted into a credit towards the winner’s basic Entry fee for the following year’s applicable Event, subject to that Event taking place and the winner satisfying the applicable registration and eligibility requirements.

Where the cash prize exceeds the applicable basic Entry fee, the remaining balance will be donated to Spirit OF Angling. Where the cash prize is less than the applicable basic Entry fee, the winner will be responsible for paying the outstanding balance in accordance with the applicable payment terms.

A cash prize winner may elect to apply all or part of their cash prize towards an Entry into another eligible Event organised by Angling Spirit. Any amount applied in this way will be treated as a payment towards that Entry and will thereafter be subject to the Terms & Conditions, payment schedule and cancellation provisions applicable to the Event concerned.

17.3 Payment of Cash Prizes

Cash prize payments will be processed using the information provided through the official Cash Prize Redemption Form. The winner is responsible for ensuring that all information and payment details submitted are complete, accurate and valid.

Where a winner requires assistance, including from a translator or other authorised representative, that person may be nominated as the contact on the Cash Prize Redemption Form. Unless otherwise expressly agreed by Angling Spirit, the prize remains payable to the rightful prize winner.

Subject to receipt and verification of a fully and correctly completed Cash Prize Redemption Form, Angling Spirit will process the cash prize payment within 28 days.

Angling Spirit may deduct from a cash prize any undisputed amount that is due and payable by the winner to Angling Spirit, to the extent permitted by law.

Where a payment is rejected, returned or cannot be completed because the winner supplied incomplete, inaccurate or invalid payment information, the winner will be required to provide corrected or alternative payment details.

Where a payment has to be reissued as a result of incorrect or incomplete information supplied by the winner, Angling Spirit may deduct any reasonable costs actually incurred in returning and reissuing the payment, together with an administration fee of £50, to the extent permitted by law.

17.4 Prize Table

Angling Spirit reserves the right to make reasonable amendments to the published Prize Table where circumstances outside its reasonable control affect the availability or specification of prizes, including changes arising under clause 17.1.

Where a sponsor substitutes or changes a prize, Angling Spirit will endeavour, where reasonably practicable, to maintain the overall advertised value of that sponsor’s contribution.

Where stated in the applicable Event information, the final Prize Table will be calculated on a pro-rata basis according to the final number of confirmed Entries.

17.5 Ties and Disputes

Any tie will be determined in accordance with the tie-break procedure specified in the applicable Event Rules.

Where an omission, ambiguity or error in the Event Rules means that no applicable tie-break procedure can reasonably determine the result, the result will be determined by reference to the recorded time of the first qualifying fish submitted through the official Event App.

Where a Participant /Marshal is unable to complete an App submission due to the absence of a mobile or data connection, a valid time-stamped screenshot or photograph showing the fish being processed through the App may be accepted as evidence, subject to verification by Angling Spirit.

Any dispute concerning the application of this procedure will be determined by Angling Spirit in accordance with the Event Rules and the available official evidence.

17.6 Cheating, Disqualification and Withdrawal of Prizes

Where, following a fair investigation, Angling Spirit determines that a Participant or Entry obtained or became entitled to a title or prize through cheating, fraud, deliberate misrepresentation or a serious breach of the Event Rules, Angling Spirit may disqualify the Participant or Entry and withdraw any associated placing, title or prize.

Where a prize has already been awarded or paid, Angling Spirit may require the return of any trophy, product or cash prize obtained as a result of the breach, to the extent permitted by law.

The official Event results and Prize Table may subsequently be amended to reflect the disqualification and, where appropriate, the relevant title, placing or prize may be awarded to the next eligible Participant or Entry in accordance with the Event Rules.

  1. EVENT BRANDING

Competitors may display commercial branding during an Event only in accordance with the applicable Event Rules and sponsorship arrangements.

Where Angling Spirit operates a Sponsor Link or equivalent programme, a brand may be required to participate in that programme before its branding may be officially associated with a competing Entry.

Unauthorised commercial branding may result in penalties in accordance with the Event Rules.

Nothing in these Terms grants a Participant, sponsor or third party any intellectual-property right in an Angling Spirit Event name, logo, trophy, title or other protected property except where expressly authorised in writing.

Subscription to a Sponsor Link Package After Registration

Following the close of official registration, a brand sponsoring a Participant or Entry may, at Angling Spirit’s sole discretion, be permitted to purchase a Sponsor Link Package and become officially associated with that Participant or Entry.

Any Sponsor Link Package purchased after the official registration deadline will be subject to the applicable late subscription fee, being six (6) times the standard Sponsor Link Package fee, subject to a minimum charge of £1,000.

Use of Competitors’ Titles by Brands

A brand may associate itself with a title won by a Participant or Entry only where the brand was officially associated with that Participant or Entry at the time the title was won, either as an official Event sponsor or through a valid Sponsor Link Package.

A brand that was not officially associated with the Participant or Entry at the time the title was won has no automatic right to use or associate itself with that title for commercial, promotional or marketing purposes.

Angling Spirit may, at its sole discretion, grant such a brand permission to use or associate itself with the title through the purchase of a separate Right to Branding Package, the terms and fee for which will be determined by Angling Spirit on a case-by-case basis.

  1. PERSONAL DATA

Angling Spirit will collect, use and retain personal data in accordance with applicable data-protection legislation and its published Privacy Policy.

Participants, including Captains, competitors and helpers, must provide accurate and up-to-date information required for the administration, organisation and delivery of an Event.

Where a Captain or other person provides personal information on behalf of another Participant, they must ensure that they are authorised to do so and that the individual has been informed of how their information may be used.

Personal data may be used for legitimate Event-related purposes, including registration, administration, safety, results, communications and the delivery of the Event.

Marketing communications will only be sent where Angling Spirit has an appropriate lawful basis to do so. Individuals may unsubscribe or withdraw their marketing consent at any time using the unsubscribe facility provided in communications or Angling Spirit’s online opt-out form.

Angling Spirit will not provide Participants’ personal data to sponsors or other third parties for their own marketing purposes unless the individual has specifically consented to this.

Further information about how personal data is collected, used, retained and protected, and how individuals may exercise their data-protection rights, is set out in Angling Spirit’s Privacy Policy.

  1. COMPLAINTS

Participants are encouraged to raise any concern with Angling Spirit or an Event Official as soon as reasonably possible so that Angling Spirit has an opportunity to investigate and, where appropriate, resolve the matter during the Event.

Formal complaints should be submitted in writing at admin”@”anglingspirit.com.

Unless a longer period is required by applicable law, Event-related complaints should ordinarily be submitted within 28 days following the Event’s prize-giving ceremony.

Failure to raise a matter during the Event may affect Angling Spirit’s ability to investigate it but does not remove any statutory right that cannot lawfully be restricted.

  1. OFFICIAL EVENT INFORMATION

The official Event website, registration information and Event Rules constitute the primary sources of operational information relating to an Event.

Angling Spirit may publish reasonable amendments to Event information or Event Rules where required for safety, regulatory, environmental or operational reasons.

Where a material change affects Participants, Angling Spirit will take reasonable steps to communicate that change through appropriate channels, which may include the Event website, email, social media or direct communication from Event Officials.

  1. NOTICES

Notices and Event communications may be sent to the email address or other contact details supplied during registration.

Participants are responsible for ensuring that their contact information remains accurate and current.

Angling Spirit will not be responsible for a Participant failing to receive a communication where it was correctly sent using the contact details supplied by that Participant, except where applicable law provides otherwise.

During the Event, the official Event App will become a primary communication channel. Participants are responsible for regularly monitoring the App for important announcements, safety information, operational updates, schedule changes and instructions issued by Angling Spirit or Event Officials.

  1. GENERAL

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision shall be treated as modified to the minimum extent necessary to make it enforceable or, where that is not possible, deleted. The remaining provisions shall continue in effect.

Any failure or delay by Angling Spirit in enforcing a provision of these Terms shall not constitute a waiver of that provision or of Angling Spirit’s right subsequently to enforce it.

No person other than a party to the contract shall have any right to enforce these Terms except where applicable law expressly provides otherwise.

These Terms, together with the applicable Event Rules, registration information and any written terms specifically agreed between Angling Spirit and the Customer, constitute the contractual terms applicable to the relevant booking.

In the event of any conflict between these Terms & Conditions and the Rules of an event, these Terms & Conditions shall take precedence in relation to contractual and commercial matters, while the relevant Event Rules shall take precedence in relation to sporting, operational, safety and competition matters.

Nothing contained within these Terms & Conditions or any Event Rules shall override applicable national, regional or local law or any lawful instruction issued by the relevant authorities.
